Obama Flouts Federal Law, Funds His ACORN Friends Despite Congressional Ban

Why is President Obama apparently defying federal law by funding ACORN?

Judicial Watch discovered that the Obama administration is flouting the will of Congress by giving federal taxpayer money to ACORN.

Obama’s Department of Housing and Urban Development (HUD) gave a $79,819 grant to the largest branch of the ACORN tree, ACORN Housing Corp. (AHC). AHC filed papers last year legally changing its name to Affordable Housing Centers of America (AHCOA). It’s the same old organization with a brand new ACORN-free name.

Worse yet, the grant funds a political agitation and indoctrination program. Here’s HUD’s euphemistic description of the program:

Education and Outreach Initiative grants (EOI) – HUD awarded $6.8 million to organizations that educate the public and housing providers about their rights and obligations under federal, state, and local fair housing laws. Groups will also conduct fair lending workshops, community meetings, and individual counseling activities focused on homeowners at risk for discrimination.

According to HUD, the grant money came out of fiscal 2010 appropriations.

That’s a big problem.

As I reported previously, in 2009 Congress passed four separate appropriations bills that contained language blocking federal funds from flowing to ACORN during federal fiscal year 2010, which ran from Oct. 1, 2009 through Sept. 30, 2010. All four of the laws prevent ACORN and its affiliated groups from receiving federal taxpayer dollars.

The funding prohibition in Public Law 111-117 (PDF) applies specifically to HUD. It spells out in pretty clear terms that ACORN shouldn’t be getting any government funding. Let’s see just how clearly it spells it out:

Division A – Section 418. None of the funds made available under this Act or any prior Act may be provided to the Association of Community Organizations for Reform Now (ACORN), or any of its affiliates, subsidiaries, or allied organizations. [p. 80 of PDF]

Division B – Section 534. None of the funds made available under this Act
may be distributed to the Association of Community Organizations for Reform Now (ACORN) or its subsidiaries. [p. 125 of PDF]

Division E – Section 511. None of the funds made available in this division
or any other division in this Act may be distributed to the Association of Community Organizations for Reform Now (ACORN) or its subsidiaries. [p. 279 of PDF]

Yet despite the ban, President Obama, who worked for ACORN as an employee and as the group’s lawyer, found it in his heart to hand over $79,819 of your money to his thug friends at ACORN.

Taxpayer funding isn’t a right: Supreme Court saved America from having budgets written by the courts

Here is the top of my op-ed that appeared in yesterday's Washington Times (and an article at WND quotes me):
America’s long-suffering taxpayers scored a resounding victory as the Supreme Court told one of the nation’s foremost tax-eating groups to take a hike.
The high court denied an appeal last week by the radical left-wing gangster group ACORN, ruling in effect that Congress was entitled to cut off federal taxpayer funding for the group, which routinely perpetrates voter fraud and encourages welfare recipients to buy houses they have no hope of paying for.
ACORN still matters because reports of its demise have been exaggerated. Although the national ACORN organization filed Chapter 7 bankruptcy on Election Day last year, ACORN is restructuring itself in time to help re-elect its former employee, President Obama, next year. ACORN’s voter-mobilization arm, Project Vote, is conducting business as usual out of ACORN’s D.C. offices.
The ACORN network has taken in an astounding $79 million in federal funding, and those are only the grants I could find in the U.S. government’s antiquated databases. The $79 million figure is $26 million more than the $53 million figure previously taken as gospel.
The Association of Community Organizations for Reform Now asked the Supreme Court to review a decision of a circuit court that had found that the funding cutoff enacted in 2009 was not a “bill of attainder” forbidden by the Constitution.
Legal scholar Hans A. von Spakovsky of the Heritage Foundation flatly rejected the argument, saying, “The bill of attainder clause has never been read to prevent Congress from defunding an organization or a corporation whose employees engage in criminal conduct, and it has rarely been invoked by the modern Supreme Court.”
Of course, liberals are often impervious to reason, preferring to see the Constitution as authorizing everything they see as good and prohibiting everything they see as bad.
In a breathtaking conflict of interest, the novel, nonsensical bill-of-attainder argument was suggested to the group by just such a liberal, Rep. Jerrold Nadler, New York Democrat, who at the time chaired an oversight panel with jurisdiction over ACORN. Mr. Nadler, who has never been accused of lacking chutzpah, has given the ACORN-affiliated Working Families Party of New York at least $66,600 since 2002. Not surprisingly, the far-left pro-labor party routinely endorses Mr. Nadler.
Even after then-House Judiciary Committee Chairman John Conyers, Michigan Democrat, publicly pleaded with Mr. Nadler to investigate ACORN over election irregularities, he steadfastly refused, claiming he would act only if hard evidence emerged of ACORN’s wrongdoings. In reality, no proof, however convincing, could ever satisfy the Manhattan congressman.
Mr. Nadler no doubt is blissfully unaware that in my book “Subversion Inc.,” I report that at least 54 people associated with ACORN have been convicted of voter fraud. Oops - scratch that - the real total is 55. Another ACORN voter-registration canvasser was convicted of election fraud in Pittsburgh after I filed my manuscript with the publisher. The total number is bound to go even higher because many of the accused ACORN workers have become fugitives from the law.
And ACORN itself was convicted of felony voter-registration fraud in Nevada in April. Sentencing in the massive conspiracy approved at the highest levels of the group is scheduled for Aug. 10 in Las Vegas. [...]

Taxpayer Funding Isn’t A Right -- Unless You're Jerrold Nadler

It may sound like an observation worthy of Captain Obvious, but activist groups do not have a constitutional right to taxpayer funding.
Amazingly, in ACORN et al. v. U.S. a federal judge in Brooklyn named Nina Gershon, not to be confused with Gina Gershon of Showgirls fame, actually ruled that ACORN had constitutionally protected rights in the congressional appropriations process and that those so-called rights had somehow been violated by an vewy vewy eeeevil vast right-wing conspiracy. Supposedly the Bill of Attainder Clause had been infringed and ACORN had been singled out for punishment without trail. This assumes, of course, that ceasing to fund an odious group like ACORN amounts to punishment.

The Second Circuit slapped Judge Gershon down hard and a few days ago the Supreme Court kept on slapping. It was a beautiful thing to see common sense and the Constitution upheld by the highest court of the land. It happens so rarely nowadays.

In a breathtaking conflict of interest, the novel, nonsensical bill of attainder argument was proposed by ACORN's de facto legal counsel Rep. Jerrold Nadler (D-N.Y.) in 2009.
At the time the ethically challenged lawmaker from the Soviet Socialist Republic of the Upper West Side happened to chair an oversight panel with jurisdiction over ACORN.
Nadler, who has never been accused of lacking chutzpah, has given the ACORN-affiliated Working Families Party of New York at least $66,600 since 2002. Not surprisingly, the far-left pro-labor party routinely endorses Nadler.

The ACORN Useful Idiot Club welcomes Peter Hart of "FAIR"

So many ACORN crime deniers, so little time.

The latest to join the ACORN Useful Idiot Club is Peter Hart, the "activism director" at FAIR, which stands for Fairness & Accuracy in Reporting.


Hart bitches about Andrew Breitbart, who publicized the undercover ACORN videos, calling him a "right-wing scam artist" and an "[i]nk [b]lot."

He whines about a New York Times profile on Breitbart which described the videos as depicting, in the words of the newspaper, "ACORN workers offering advice on how to evade taxes and conceal child prostitution."

That wasn't the lesson of the ACORN videos at all. After  a long battle, the Times admitted that much of its coverage of the Breitbart/James O'Keefe videos was misleading. The paper told readers that O'Keefe actually went into ACORN offices dressed in a ridiculous "pimp" get-up. He did not.
Whether O'Keefe was dressed up as a stereotypical pimp (the videos show him entering ACORN offices in regular clothes) is a tedious red herring. The videos clearly show ACORN employees going out of their way to provide advice on how to break the law. Period.

Not surprisingly, Hart's fake media watchdog employer is bought and paid for by the Left.

FAIR is funded by a mixture of left-of-center and extreme left grant makers. Since 2000 the Tides Foundation has given  FAIR $81,844. Tides founder Drummond Pike is the gentleman who paid around $700,000 in hush money to try to keep the million dollar embezzlement scandal at ACORN under wraps. Pike is also treasurer of George Soros's Democracy Alliance, a group of radical billionaires who want to turn America into Greece.

Other donors to FAIR include the Ford Foundation ($400,000 since 2001), Glaser Progress Foundation ($20,000 in 2001), Schumann Center for Media and Democracy Inc. ($815,000 since 2003), Funding Exchange Inc. ($30,000 since 2003), and the Ithaca, N.Y.-based Park Foundation Inc. ($50,000 since 2005). 

Needless to say, FAIR isn't fair.

Justice Has Never Been High on Eric Holder's Docket

Although Eric Holder, who cannot conceal his visceral contempt for conservatives, heads the U.S. Department of Justice, doing the right thing isn't high on his list of priorities.


As Barack Obama gears up to use the White House (illegally?) for fundraising purposes, a case in point is the "maxed out" donors scandal.

As I explain in my new book, Subversion Inc.: How Obama's ACORN Red Shirts are Still Terrorizing and Ripping Off American Taxpayers, former ACORN employee Anita MonCrief testified under oath in 2008 that the Obama campaign gave a list of "maxed out" campaign donors to ACORN's voter mobilization affiliate Project Vote so it could hit up those donors for more cash. Of course, ACORN's Project Vote used to employ President Obama as a get-out-the-vote organizer.

According to MonCrief, Obama donors who had already given the legal limit could secretly give more money to the Obama cause by donating to ACORN, which everyone (except the members of ACORN's useful idiots club) knows only helps Democrats. Obama considered ACORN to be an arm of his campaign. That's why his campaign paid ACORN affiliate Citizens Services Inc. to do partisan political work.

The Obama campaign disguised its $832,598 payment to Citizens Services Inc., falsely describing it in campaign finance filings as "polling, advance work and staging major events." In reality, CSI performed get-out-the-vote services. After the subterfuge was uncovered, the Obama campaign claimed it had simply goofed up and filed an amended report with the Federal Election Commission.

Whoops.

This could be a violation of election laws but Attorney General Holder couldn't care less. Nor could the New York Times, which had the potential game-changer of a story but spiked it just before Election Day.

Michelle Malkin and the fastidious (and ornery) blogger Michael Gaynor have been beating the drum for a proper federal investigation for years now, to no avail.

With his astonishingly brazen track record for lawlessness, don't hold your breath expecting Holder to do anything about the Obama maxed-out donors scandal.

The ACORN 'Useful Idiot' Club Welcomes Cynthia Tucker

Atlanta Journal-Constitution pontificator Cynthia Tucker is never right about, well, anything, so it's no surprise that she too has become an ACORN voter fraud denier. (By the way, it's more fun when Rush Limbaugh calls the paper the Atlanta Urinal and Constipation, isn't it?)

I know what you're thinking: What about ACORN and its massive fraud?

Well, quiet as it's kept, neither ACORN nor its hired hands engaged in voter fraud.

Because of its sloppy management practices, ACORN ended up with a few cheating workers who registered children or ex-felons or others who were not eligible (Mickey Mouse showed up on a list in Florida).
ACORN routinely engaged in voter fraud. Tucker is playing the same game of semantics that left-wing pseudojournalist Brad Friedman plays.

Voter fraud (also called electoral fraud or election fraud) is a blanket term encompassing a host of election-related improprieties including fraudulent voting, voter registration fraud, forgery, impersonation, identity theft, bribery, manipulating a voting machine, ballot box stuffing, false swearing, absentee ballot fraud, and many, many other crimes.

As I write in my new book Subversion Inc.: How Obama's ACORN Red Shirts are Still Terrorizing and Ripping Off American Taxpayers, at least 54 individuals associated with ACORN have been convicted of voter fraud. ACORN itself was convicted of felony voter registration fraud in Nevada in April.

ACORN, a former employer and legal client of President Obama, didn't have "sloppy management practices" as such. The group actively encouraged voter registration canvassers to make up names such as Mickey Mouse and Mary Poppins on voter registration forms. The fraud was planned and sanctioned at the highest levels in the organization -- as the Nevada conviction proves.

Tucker joins a growing list of useful idiots toeing the hard left's party line on ACORN.

O'Reilly Factor: Newt Gingrich Lays Into Sarah Palin, Rudy Giuliani

Ingraham noted that, according to Subversion Inc., Gingrich criticized Sarah Palin and Rudy Giuliani for treating Barack Obama's background in radical left-wing community organizing as a joke. In my exclusive interview with Gingrich he said throwing rhetorical potshots at Obama at the 2008 Republican national convention "trivialized" Obama who is not at all a trivial person. In Gingrich's view, Palin and Giuliani should have warned Americans about how dangerous and radical Obama was.

Terrorist-Linked ACORN Shill Brad Friedman Lies, Lies, and Lies Some More

Left-wing pseudojournalist Brad Friedman thinks everything reported about ACORN is overblown. It's all a scheme concocted by a vast right-wing conspiracy. Clearly he hasn't read my book, Subversion Inc.: How Obama's ACORN Red Shirts are Still Terrorizing and Ripping Off American Taxpayers.


Friedman, who routinely chokes on his own robust self-esteem, is often a substitute host on the "Mike Malloy Show." Malloy has serious, shall we say, psychiatric issues. He has called for the murder of former President George W. Bush, described Fox News as a "terrorist organization" that "wants to burn the country down," and characterized Congresswoman Michele Bachmann (R-Minnesota) as a "whore," "streetwalker," and a "crazy bitch."

Filling in for his straitjacket-worthy buddy Malloy a few days ago, Friedman, who is also a business partner of convicted "Speedway Bomber" Brett Kimberlin (see mugshot below), unloaded everything that has been bugging him about the alleged persecution of the ACORN crime syndicate. (The audio clip is available at Friedman's blog. Friedman thinks the undercover "pimp and prostitute" videos are a hoax and that Andrew Breitbart should be in jail. He wants the videographers, James O'Keefe III and Hannah Giles, to "pay" for whatever it is they supposedly did to poor little ACORN. He accuses anyone who thinks voters should have to present ID in order to vote as engaging in "voter suppression."

Friedman also doesn't seem to understand the term voter fraud, making a fool of himself on Fox News with John Fund in 2008. The obnoxious Friedman jumps all over Fund, insisting that voter fraud and the voter registration fraud that Fund is apparently referencing are entirely separate things. "There's a big difference" between the two, Friedman says.

In fact, voter registration fraud is a variety of voter fraud. Voter fraud (also called electoral fraud or election fraud) is a blanket term encompassing a host of election-related improprieties including fraudulent voting, forgery, impersonation, identity theft, bribery, manipulating a voting machine, ballot box stuffing, false swearing, absentee ballot fraud, and many, many other crimes.

In other words, all voter registration fraud is voter fraud but not all voter fraud is voter registration fraud.

This is Friedman's shtick. He uses it routinely to downplay the exhaustively documented crimes of ACORN against the integrity of America's electoral system.

Said Friedman on the Malloy show:
Where is the ACORN voter fraud? It doesn't exist! It never existed! There is not one single vote, no evidence - no evidence of any single vote ever having been cast following an improper ACORN registration. Not one fraudulent vote! For all that you've heard and how they're stealing elections for Democrats...never happened, not once! It's completely phony, it's completely made up, and it's made up for one reason - so that the same Republicans who are lying about it can turn around, pass bills that keep you from being able to cast your legal vote because they can't win elections if everybody gets to vote. They've got to game the system! And that's what they do, that's what they did! Democrats and Obama should be ashamed of themselves to have signed on for defunding ACORN, but they did it.
Tedious stuff.

Pedophiles Weep as Supreme Court Backs Congressional Cutoff of ACORN Funding

The U.S. Supreme Court today denied a petition for review from ACORN, ruling in effect that Congress was absolutely entitled to cut off federal taxpayer funding of ACORN, the depraved radicals who used to employ President Obama.

The Association of Community Organizations for Reform Now had asked the high court to review a decision of the U.S. Court of Appeals for the Second Circuit which found that the funding cutoff was not a "bill of attainder" banned by the Constitution. ACORN had advanced the nonsensical argument that Congress had no power to stop funding the group unless it could prove it had done something wrong.

ACORN became well known nationwide in 2009 for its advocacy of brothels for pedophiles. Hannah Giles and James O'Keefe caught the group on undercover video offering advice on importing underage illegal alien sex slaves from El Salvador, tax fraud, and tax evasion.

As I write in my new book Subversion Inc.: How Obama's ACORN Red Shirts are Still Terrorizing and Ripping Off American Taxpayers, at least 54 individuals associated with ACORN has been convicted of voter fraud. ACORN itself was convicted of felony voter registration fraud in Nevada in April.

Not surprisingly, a chorus of useful idiots has arisen to defend ACORN, including but not limited to Eric Alterman and Katrina vanden Heuvel of the Nation, Joe Conason of Salon, Adam Serwer of the American Prospect, and terrorist-linked blogger Brad Friedman.

Are there ONLY four reasons why Eric Alterman 'sucks'?

Somebody over at the Nation magazine has thin skin.

Worthless pseudointellectual pseudojournalist Eric Alterman didn't like my blog post calling him out for his lie that ACORN has ceased to exist. In fact, as I pointed out, ACORN's two largest affiliates (ACORN Housing and Project Vote) continue to operate and ACORN's state chapters are continuing to do business under new names.

In an amusingly titled blog post ("Four Reasons I Suck") the Nation poseur writes
Let me be clear. I do think this Matthew Vadum fellow is an idiot, though the above is all I know about him, so for all I know, he could be a hoax. As for “you,” I don’t know you well enough to say, but perhaps this Mr. Vadum does, if in fact he does exist.
Ha. I exist, or at least I did last time I checked.

Canada was absolutely right to deny entry to unrepentant American terrorist Bill Ayers.

Ayers, a self-described “small-c communist,” was barred Wednesday by the Canadian Border Services Agency. He had hoped to spread his visceral hatred of freedom and democracy at the Worldview Conference on Media and Higher Education on Thursday in Toronto. The conference was co-sponsored by the notorious Ontario Institute for Studies in Education (OISE) at the University of Toronto. OISE is well known for its embrace of radical left-wing politics.

According to the National Post, conference organizers whined that Ayers was being denied his so-called academic freedom. A spokesperson said Ayers’s refused admission to the country “should raise red flags for citizens concerned with free and open debate.”

The spokesperson is absolutely right. Those flags should be red. Bright red.

The now-retired education professor was a leader of the communist Weather Underground, a terrorist group that bombed U.S. targets, including the Pentagon, throughout the late 1960s and ‘70s. He said he doesn’t regret the bombings and has never disavowed the use of violence to achieve political change.

The Weather Underground plotted to use dynamite to murder military officers at a dance in Fort Dix, New Jersey in 1970. The only reason the bombing didn’t take place is because his comrades blew themselves up while making bombs in New York City.

Radical activist groups associated with President Barack Obama have launched a campaign of economic terrorism and sabotage – possibly with his blessing. Mortgage and student loan strikes, crippling bank boycotts, intimidation, and who knows what else are all on the agenda.

The idea of leftists using terrorism to achieve political objectives isn’t new. Leon Trotsky supported the use of terrorism to advance so-called social justice. Decades before an ice-axe found its way into his skull, Trotsky argued in Dictatorship vs. Democracy that Communists who reject “terrorism in principle” weren’t bona fide Communists. Years before that, he justified “proletarian terrorism” because the capitalist state itself, with its “entire state apparatus with its laws, police, and army is nothing but an apparatus for capitalist terror.” In the upside-down world of Marxists, radical activists’ frightening, violent, in-your-face tactics are thought of as merely fighting fire with fire.
